EC opens seven new infringement cases against Bulgaria

The European Commission said on January 30 that it opened two new infringement cases against Bulgaria for fully transposing or failing to notify the transposition of EU directives into national law.

In its latest infringements package, the EC said that it was sending letters of formal notice, the first stage in the infringement process, across a number of areas, including two new cases regarding the implementation EU rules on taxation-related matters.

The cases in question refer to EU’s new rules as regards tax transparency and information exchange regarding crypto-assets, as outlined in Directive (EU) 2023/2226, as well as new information exchange rules on administrative cooperation in the field of taxation, listed in Directive (EU) 2025/872.

Four other new infringement cases against Bulgaria concern the country’s failure to implement EU rules on information exchanges related to terrorist offences with EU data protection framework (Directive (EU) 2023/2123), financial services contracts concluded at a distance (Directive (EU) 2023/2673), credit agreements for consumers (Directive (EU) 2023/2225) and budgetary framework (Directive (EU) 2024/1265).

Separately, the Commission opened a new case due to Bulgaria failing to withdraw from the Energy Charter Treaty after the European Union and Euratom withdrew from that Treaty in June 2025.

The EC said that Bulgaria had two months to reply to the letters of formal notice and complete the transposition of EU rules in those areas, otherwise the Commission may decide to take the cases into the second stage of the infringement process by issuing a reasoned opinion.

The Commission said that it was taking that step in one existing infringement case, due to Bulgaria breaching the Methane Regulation (EU) 2024/1787 by failing to appoint a competent authority responsible for monitoring and enforcing the application of the rules.
