EC opens new infringement cases against Bulgaria on cybersecurity, critical infrastructure
The European Commission said on November 28 that it opened new infringement cases against Bulgaria for failing to fully transpose two new EU directives on cybersecurity and protection of critical infrastructure before the October 17 deadline.
Bulgaria was not alone in receiving the Commission’s letters of formal notice, as the EC said that it was opening infringement proceedings for failing to transpose Directive 2022/2555 on cybersecurity (also known as the NIS2 Directive) against 23 member states, while 24 member states were in infringement of EU rules by failing to transpose Directive (EU) 2022/2557 on the resilience of critical entities (known as the CER Directive).
The Commission said that the goal of the NIS2 Directive was to ensure a high level of cybersecurity across the EU and covered entities operating in critical sectors such as public electronic communications services, ICT service management, digital services, wastewater and waste management, space, health, energy, transport, manufacturing of critical products, postal and courier services, and public administration.
The CER Directive, meanwhile, aimed to shift focus from the protection of critical infrastructure to enhancing the resilience of the entities operating that infrastructure, by strengthening the resilience of critical infrastructure and critical entities against a range of threats, including natural hazards, terrorist attacks, insider threats, or sabotage.
It also expanded the sectors falling under its purview, now including key sectors such as energy, transport, health, water, banking and digital infrastructure, the EC said.
